This End-User Licence Agreement ("EULA") is a legal agreement between you and Eidos Interactive Limited ("Eidos" or "we") for the computer game software stated above, which includes computer software and associated media, materials and other documentation together with any updates to the original game software which is provided to you ("Software Product"). 

Copyright and other intellectual property laws and treaties protect this Software Product. The Software Product is licensed, not sold.



WE ARE ONLY PREPARED TO LICENCE YOU TO USE THE SOFTWARE PRODUCT ON THE TERMS OF THIS EULA. PLEASE READ THROUGH THE FOLLOWING LICENCE CONDITIONS. IF YOU AGREE TO BE BOUND BY THEM PLEASE CLICK [I ACCEPT] AT THE END OF THIS EULA AT WHICH POINT THE SOFTWARE PRODUCT WILL BE LOADED ONTO YOUR COMPUTER. IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS OF THIS EULA CLICK [NOT ACCEPTED] AND THE SOFTWARE PRODUCT WILL NOT BE LOADED ONTO YOUR COMPUTER. IF YOU DO NOT ACCEPT THE TERMS OF THIS EULA, PLEASE RETURN THE DISK UNUSED TOGETHER WITH ITS PACKAGING AND DOCUMENTATION TO THE POINT OF PURCHASE FOR A REFUND OF THE PURCHASE PRICE FOR THE SOFTWARE PRODUCT. THE SUPPLIER RESERVES THE RIGHT, WITHOUT PREJUDICE TO YOUR STATUTORY RIGHTS WHICH ARE NOT AFFECTED, TO WITHHOLD SOME OR ALL OF THE REFUND IF SUCH DISK, PACKAGING OR DOCUMENTATION HAS BEEN DAMAGED IN ANY WAY.



1. Technical Support

If you require technical assistance, please refer to the manual accompanying the Software Product or our web site at http://www.eidos.com, or otherwise contact either: The European Technical Support helpline on: 0870 90000222  OR The North American helpline at  415-615-6220.

You will be responsible for all telephone charges.



2. Licence

You are permitted to:

(a) load the Software Product into and use it on a single computer which is under your custody and control and which meets the specifications referred to in the manual for your own private and domestic use;

(b) transfer the Software from one computer to another provided it is used on only one computer at any one time and any computer on which it is used is under your custody and control at the time of use;

(c) transfer the Software Product (complete with all documentation) and the benefit of this EULA to another person provided such person has agreed to accept the terms of this EULA and you contemporaneously transfer any permitted copies of the Software Product you may have made to that person or destroy all copies not transferred. If any transferee does not accept such terms then this EULA shall automatically terminate. 

All rights not expressly granted hereunder are, to the extent permitted by law, reserved to Eidos and its licensors. Your rights of use under this EULA are strictly conditional upon your observance of the terms and conditions contained in this Agreement.



3. Restrictions

You are not permitted:

(a) to load the Software Product on to a network server for the purposes of distribution to 

one or more other computer(s) on that network or to effect such distribution;

(b) except as expressly permitted by this EULA and save and to the extent in the circumstances expressly permitted by applicable law, to rent, lease, sub-licence, loan, exploit for profit or gain, copy, modify, adapt, merge, translate, reverse engineer, decompile, disassemble or create derivative works based on the whole or any part of the Software Product or use, reproduce or deal in the Software Product or any part thereof in any way.



4.  Termination

Without prejudice to any other rights, Eidos may terminate this EULA immediately without notice if you fail to comply with the terms and conditions of this EULA. In the event of termination, you must destroy all copies of the Software Product and all of its component parts including any Software Product stored on the hard disk of any computer. All provisions of this EULA relating to disclaimers of warranties, limitations of liability, remedies, or damages, and Eidos  proprietary rights shall survive termination.





5.  Ownership

You only own the media on which the Software Product is recorded. Eidos and/or its licensors shall at all times retain ownership of the Software Product as recorded on the media and all subsequent copies regardless of form.



6.  Limited Warranty and Exclusions



6.1  LIMITED WARRANTY



This limited warranty is in addition to, and does not affect your statutory rights.

Eidos warrants to the original purchaser of this Software Product that the physical medium on which the Software Product is recorded will under normal use and conditions be free from material defects in materials and workmanship for a period of ninety (90) days from the date of purchase. The entire liability of Eidos under this limited warranty will be, at Eidos' sole option, either (a) to return of the 

purchase price paid; or (b) to repair or, at Eidos  option, to replace free of charge the Software Product that does not meet this limited warranty provided you return the original physical medium in its original condition to the point of purchase or Eidos at the address specified in the manual accompanying this Software Product, together with a dated proof of purchase, a statement describing the defects and a return address. Eidos will pay the costs of sending a replacement Software Product to you. 



6.2  The limited warranty in paragraph 6.1 above is void and shall not apply to media which has been subject to misuse, accident, damage or excessive wear. Any replacement Software Product will be warranted for the remainder of 

the original warranty period or thirty (30) days, whichever is longer.





6.3 THE LIMITED WARRANTY IN PARAGRAPH 6.1 DOES NOT APPLY TO THE SOFTWARE PROGRAMS THEMSELVES WHICH ARE PROVIDED "AS IS"  AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EIDOS AND ITS LICENSORS DISCLAIMS ALL OTHER 

REPRESENTATIONS, WARRANTIES, CONDITIONS OR OTHER TERMS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS AND FITNESS FOR A PARTICULAR PURPOSE, WITH REGARD TO THE SOFTWARE PRODUCT AND EACH AND EVERY PART THEREOF. WITHOUT 

PREJUDICE TO THE GENERALITY OF THE FOREGOING, EIDOS DOES NOT WARRANT THAT THE SOFTWARE PRODUCT IS ERROR-FREE OR THAT IT WILL OPERATE WITHOUT INTERRUPTION, NOR THAT IT WILL REPAIR ANY ERRORS IN THE SOFTWARE PRODUCT.



6.4 IN ADDITION, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

(A) IN NO EVENT SHALL EIDOS OR ITS LICENSORS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR PERSONAL INJURY, LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, OR ANY PECUNIARY LOSS) ARISING OUT 

OF THE USE OF OR INABILITY TO USE THIS SOFTWARE PRODUCT, EVEN IF EIDOS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(B) IN ANY CASE, THE MAXIMUM AGGREGATE LIABILITY OF EIDOS AND ITS LICENSORS UNDER OR IN RELATION TO THIS EULA OR THE USE OR ATTEMPTED USE OF THIS SOFTWARE PRODUCT SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE PRODUCT.



6.5 Nothing in this EULA shall limit or exclude Eidos' liability to you in negligence for death or personal injury, to the extent such exclusion or limitation is unlawful, unenforceable or void under any applicable law.



6.6 Some jurisdictions do not permit the warranty disclaimers or limitations on liability set forth in this paragraph 6. Nothing  in this paragraph 6 shall affect your statutory rights which may vary from state/jurisdiction to state/jurisdiction.







7.  Governing Law



7.1 Subject to paragraph 7.2 below, this EULA and any claim or dispute of whatever nature arising out of or relating to this EULA shall be governed by, and construed in accordance with, the laws of England and Wales, unless and to the extent that the laws relating to transactions with consumers in a particular jurisdiction require this EULA to be governed by and construed in accordance with the laws of such jurisdiction in order to be binding and enforceable, in which event the local laws of such jurisdiction shall apply, to the extent so required.



7.2 If you acquired this Software Product in the United States of America this EULA and any claim or dispute of whatever nature arising out of or relating to this EULA shall be governed by, and construed in accordance with, the laws of the State of California, USA.



7.3	The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this EULA.



8.	Miscellaneous



8.1	If you acquired this Software Product in the United States of America, you will not export or re-export it except as authorized and permitted by the laws and regulations of the United States of America.  

8.2	This EULA constitutes the entire agreement between Eidos and you with respect to the license and use of the Software Product and supersedes all prior or contemporaneous understandings.  No amendment or modification of this EULA will be binding unless made in writing and signed by a duly authorized representative of Eidos.

2. Licence

Vous tes autoris  :

(a) charger le logiciel et  l utiliser sur un ordinateur contrl par vous qui correspond aux spcifications indiques dans le manuel pour votre utilisation prive ;

(b) transfrer le logiciel d un ordinateur  un autre,  condition qu il soit utilis uniquement sur un ordinateur  la fois et que tout ordinateur sur lequel il est utilis soit contrl par vous au moment de l utilisation ;

(c) transfrer le Produit Logiciel (et toute sa documentation) et ce CLUF  une autre personne,  condition que celle-ci en accepte les conditions et que vous transfriez au mme moment  cette personne toute copie autorise du Produit Logiciel que vous avez pu faire ou que vous dtruisiez toute copie non transfre. Si le bnficiaire du transfert n accepte pas ces conditions, ce CLUF sera rsili automatiquement. 

Tous les droits non expressment accords ci-dessous sont, dans la limite des dispositions prvues par la loi, rservs  Eidos et  ses concdants de licences. Vos droits d utilisation dcrits dans ce CLUF dpendent de votre respect des termes et conditions de cet accord.



3. Limitations

Vous n tes pas autoris :

(a)  charger le logiciel sur un serveur de rseau dans le but de le distribuer  

un ou plusieurs ordinateur(s) sur ce rseau ou d obtenir cette distribution ;

(b)  louer, cder sous licence, sous-louer, prter, exploiter dans un but lucratif, copier, modifier, adapter, fusionner, traduire, procder  une ingnierie inverse, dcompiler, dsassembler ou crer des produits drivs  partir de ce produit, en tout ou en partie, ou  utiliser, reproduire ou distribuer le Produit Logiciel, en tout ou en partie, de quelque faon que ce soit, sauf si cela est expressment autoris par ce CLUF et sauf dans les circonstances o cela est expressment autoris par la lgislation en vigueur.



4. Rsiliation

Eidos est autoris  rsilier ce CLUF immdiatement et sans pravis si vous n en respectez pas les termes et conditions, sans que cela n affecte vos autres droits. En cas de rsiliation, vous tes tenu de dtruire toute copie du Produit Logiciel et de tous ses composants, y compris tout Produit Logiciel conserv sur le disque dur de votre ordinateur. Toutes les dispositions de ce CLUF concernant les dngations de garanties, les limitations de responsabilit, recours ou dommages, ainsi que les droits de proprit de Eidos resteront valables aprs la rsiliation.





5. Proprit

Vous n tes propritaire que du support sur lequel est enregistr le Produit Logiciel. Eidos et/ou ses concdants de licence conservent  tout moment la proprit du Produit Logiciel tel que celui-ci est enregistr sur le support et de toutes les copies qui en sont faites, sous quelque format que ce soit.



6. Limitation de garantie et exclusions



6.1 GARANTIE LIMITE



Cette garantie limite vient s ajouter  vos droits statutaires et n y contrevient pas.

Eidos garantit  l acheteur d origine de ce Produit Logiciel que le support physique sur lequel les programmes logiciels ont t enregistrs ne rencontrera, dans des conditions normales d utilisation, aucune dfaillance en termes de matriaux ou de fabrication pendant une priode de 90 jours  compter de la date d achat. L entire responsabilit de Eidos dans le cadre de cette garantie limite sera,  sa seule discrtion, soit (a) de vous rembourser le prix d achat ; soit (b) de rparer ou de remplacer gratuitement le Produit Logiciel ne correspondant pas  cette garantie limite. Vous devrez pour cela renvoyer le support physique d origine dans son tat initial  l endroit o vous l avez achet ou  Eidos,  l adresse prcise dans le manuel accompagnant ce Produit Logiciel, ainsi qu une preuve d achat date, une description de la dfaillance et une adresse  laquelle le produit doit vous tre renvoy. Eidos prendra en charge les frais d envoi de votre Produit Logiciel de remplacement. 



6.2 La garantie limite du paragraphe 6.1 ci-dessus est nulle et ne sera pas applique si le support a fait l objet d une mauvaise utilisation, d un accident, de dommages ou d usure excessive. Tout Produit Logiciel de remplacement sera couvert pour le reste de la priode de garantie d origine ou pendant trente (30) jours, selon la plus longue de ces deux occurrences.





6.3 LA GARANTIE LIMITE DU PARAGRAPHE 6.1 NE S APPLIQUE PAS AUX PROGRAMMES LOGICIELS EUX-MMES, QUI SONT FOURNIS  TELS QUELS  ET SANS GARANTIE QUELLE QU ELLE SOIT. DANS LA LIMITE DES DISPOSITIONS PRVUES PAR LA LGISLATION EN VIGUEUR, EIDOS ET SES CONCDANTS DE LICENCE DCLINENT TOUTE AUTRE REPRSENTATION, GARANTIE OU CONDITION, EXPRESSES OU IMPLICITES, Y COMPRIS, SANS QUE CETTE NUMRATION NE SOIT LIMITATIVE, LES GARANTIES ET/OU CONDITIONS IMPLICITES DE COMMERCIABILIT, DE QUALIT, DE NON-VIOLATION DES DROITS DE PROPRIT INTELLECTUELLE ET D ADQUATION  UN BUT PARTICULIER, CONCERNANT CE PRODUIT LOGICIEL ET TOUS SES COMPOSANTS. SANS QUE CELA NE PORTE ATTEINTE  CE QUI PRCDE, EIDOS NE GARANTIT PAS QUE LE PRODUIT LOGICIEL NE COMPORTE PAS D ERREURS, QU IL FONCTIONNERA SANS INTERRUPTION, OU QUE LA SOCIT PRENDRA EN CHARGE LA RPARATION DE SES VENTUELLES DFAILLANCES.



6.4 EN OUTRE, DANS LA LIMITE DES DISPOSITIONS PRVUES PAR LA LGISLATION EN VIGUEUR :

(A) EN AUCUN CAS, EIDOS OU SES CONCDANTS DE LICENCE NE POURRONT TRE TENUS RESPONSABLES DE TOUT DOMMAGE QUEL QU IL SOIT (Y COMPRIS, SANS QUE CETTE NUMRATION NE SOIT LIMITATIVE, TOUT DOMMAGE DIRECT, INDIRECT, ACCESSOIRE OU IMMATRIEL, POUR TOUTE BLESSURE PHYSIQUE, PERTE DE PROFITS, INTERRUPTION D ACTIVIT, PERTE D INFORMATIONS, OU TOUTE PERTE D ARGENT) ISSU DE 

L UTILISATION OU DE L IMPOSSIBILIT D UTILISER CE PRODUIT LOGICIEL, MME SI EIDOS A T PRVENU DE LA POSSIBILIT DE TELS DOMMAGES.

(B) DANS TOUS LES CAS, LA RESPONSABILIT TOTALE MAXIMUM DE EIDOS ET DE SES CONCDANTS DE LICENCE, DANS LE CADRE DE CE CLUF OU EN RELATION  CELUI-CI OU DANS LE CADRE DE L UTILISATION OU DE TOUTE TENTATIVE D UTILISATION DE CE PRODUIT LOGICIEL, SERA LIMITE AU MONTANT QUE VOUS AVEZ VERS POUR ACQURIR CE PRODUIT LOGICIEL.



6.5 Aucune disposition de ce CLUF ne peut limiter ou exclure la responsabilit de Eidos envers vous en cas de ngligence entranant la mort ou une blessure physique. Une telle exclusion ou limitation serait illgale, inapplicable ou nulle selon la lgislation en vigueur. 



6.6 Certaines juridictions interdisent les dngations de garanties ou limitations de responsabilit nonces dans ce paragraphe 6. Aucune mention de ce paragraphe 6 n affecte vos droits statutaires, qui peuvent varier d une juridiction  l autre.







7. Lgislation applicable



7.1 Dans les limites du paragraphe 7.2 ci-dessous, ce CLUF ainsi que toute rclamation ou revendication y affrentes, de quelque nature que ce soit, doivent tre rgis et interprts selon la lgislation applicable en Angleterre et au Pays de Galles, sauf si les lois concernant les transactions avec les clients dans une certaine juridiction exigent que ce CLUF soit rgi et interprt selon les lois de ladite juridiction afin de pouvoir tre applicable et excutoire, auquel cas la lgislation de ladite juridiction sera applique, dans les limites prvues.



7.2 Si vous avez achet ce Produit Logiciel aux tats-Unis, ce CLUF et toute rclamation ou revendication y affrentes, de quelque nature que ce soit, seront rgis et interprts selon la lgislation en vigueur dans l tat de Californie, tats-Unis.



7.3	La Convention des Nations Unies sur les contrats de vente internationale de marchandises ne s applique pas  ce CLUF.



8.	Divers



8.1	Si vous avez achet ce logiciel aux tats-Unis, vous ne pourrez pas l exporter ou le r-exporter sauf si les lois et rglementations des tats-Unis l autorisent. 

8.2	Ce CLUF constitue l intgralit de l accord entre Eidos et vous au sujet de cette licence et de l utilisation de ce Produit Logiciel et prvaut sur tout autre accord pass ou actuel. Aucun amendement ou aucune modification de ce CLUF ne sera excutoire, sauf si cela a t fait par crit et sign par un reprsentant agr de Eidos.

2. Lizenz

Es ist Ihnen gestattet:

(a) das Softwareprodukt fr Ihren eigenen privaten Heimgebrauch auf einen einzigen Computer, der unter Ihrer Obhut und Kontrolle steht und der die in dem Handbuch genannten Spezifikationen erfllt, zu laden und zu nutzen; 

(b) die Software von einem Computer auf einen anderen zu bertragen, vorausgesetzt, sie wird immer nur auf einem Computer genutzt und jeder Computer, auf dem sie genutzt wird, steht zum Zeitpunkt der Benutzung unter Ihrer Obhut und Kontrolle;

(c) das vollstndige Softwareprodukt (einschlielich smtlicher Dokumentation) und die Vorteile aus diesem Lizenzvertrag auf eine andere Person zu bertragen, vorausgesetzt, diese Person hat der Anerkennung der Bestimmungen dieses Lizenzvertrages zugestimmt und Sie bertragen gleichzeitig smtliche von Ihnen erstellten zulssigen Kopien des Softwareprodukts auf diese Person oder vernichten alle zurckbehaltenen Kopien. Sollte ein Empfnger diese Bedingungen nicht anerkennen, wird dieser Lizenzvertrag automatisch gekndigt. 

Alle Rechte, die hieraus nicht ausdrcklich gewhrt werden, sind Eidos und dessen Lizenzgebern in dem gesetzlich zulssigen Umfang vorbehalten. Ihre Nutzungsrechte aus diesem Lizenzvertrag unterliegen grundstzlich der Einhaltung der in diesem Lizenzvertrag aufgefhrten Bestimmungen und Bedingungen durch Ihre Person.



3. Beschrnkungen

Es ist Ihnen nicht gestattet:

(a) das Softwareprodukt auf einen Netzwerkserver zu laden, um es 

auf einen oder mehrere Computer in einem solchen Netzwerk zu verteilen oder eine solche Verteilung zu bewirken;

(b) das Softwareprodukt zu vermieten, zu verleasen, eine Unterlizenz davon zu gewhren, zu verleihen, zur Erzielung von Gewinn oder Einknften zu verwerten, zu kopieren, zu modifizieren, anzupassen, mit anderer Software zu verbinden, zu bersetzen, zurckzuentwickeln, zu dekompilieren, zu disassemblieren oder abgeleitete Werke aus dem vollstndigen Softwareprodukt oder einem Teil des Softwareprodukts zu schaffen oder das Softwareprodukt oder einen Teil davon in jeglicher Weise zu nutzen, zu reproduzieren oder damit zu handeln, es sei denn, dies wird durch diesen Lizenzvertrag ausdrcklich gestattet, und auer in den Fllen und in dem Umfang, die durch anwendbares Recht ausdrcklich gestattet sind.



4.  Kndigung

Unbeschadet sonstiger Rechte kann Eidos diesen Lizenzvertrag unverzglich und ohne Fristwahrung kndigen, sollten Sie gegen die Bestimmungen und Bedingungen dieses Lizenzvertrages verstoen. Im Falle einer Kndigung sind Sie verpflichtet, smtliche Kopien des Softwareprodukts und alle seine Komponenten zu vernichten, einschlielich jedes auf der Festplatte eines Computer gespeicherten Softwareprodukts. Smtliche Bestimmungen dieses Lizenzvertrages hinsichtlich Haftungsausschlssen, Haftungsbeschrnkungen, Rechtsmitteln oder Schadenersatz sowie der Eigentumsrechte von Eidos bestehen nach einer Kndigung fort.





5.  Eigentum

In Ihrem Eigentum stehen nur die Medien, auf denen das Softwareprodukt aufgezeichnet ist. Eidos und/oder dessen Lizenzgeber sind zu jeder Zeit Eigentmer des Softwareprodukts, so wie es auf den Medien aufgezeichnet wurde, und aller spteren Kopien, unabhngig von deren Form.



6.  Beschrnkte Gewhrleistung und Ausschlsse



6.1  BESCHRNKTE GEWHRLEISTUNG



Diese beschrnkte Gewhrleistung gilt neben den gesetzlichen Garantiebestimmungen, ohne diese einzuschrnken.

Eidos gewhrleistet dem ursprnglichen Kufer dieses Softwareprodukts fr einen Zeitraum von neunzig (90) Tagen ab Kaufdatum, dass das physikalische Medium, auf dem das Softwareprodukt aufgezeichnet ist, bei normaler Nutzung und unter normalen Bedingungen keine Material- und Verarbeitungsfehler aufweist. Die gesamte Haftung von Eidos aus dieser beschrnkten Gewhrleistung besteht, im alleinigen Ermessen von Eidos, entweder (a) in der 

Rckerstattung des gezahlten Kaufpreises oder (b) in der Reparatur oder, nach Wahl von Eidos, dem kostenlosen Ersatz des Softwareprodukts, das diese beschrnkte Gewhrleistung nicht erfllt, vorausgesetzt, Sie geben das ursprngliche physikalische Medium im Originalzustand mit einem mit Datum versehenen Kaufnachweis, einer Beschreibung der Fehler und einer Rcksendeadresse an die Verkaufsstelle oder an die Adresse von Eidos zurck, die in der Begleitdokumentation zu diesem Softwareprodukt angegeben ist. Eidos bernimmt die Kosten, die bei der Sendung eines Ersatzes des Softwareprodukts an Sie, anfallen. 



6.2  Die beschrnkte Gewhrleistung nach Absatz 6.1 ist nichtig und gilt nicht fr Medien, bei denen unsachgeme Handhabung, Unfall, Beschdigung oder bermige Abnutzung vorliegen. Jeder Ersatz des Softwareprodukts wird fr die restliche Zeit des

Gewhrleistungszeitraums oder dreiig (30) Tage, je nachdem, welcher Zeitraum lnger ist, gewhrleistet.





6.3 DIE BESCHRNKTE GEWHRLEISTUNG NACH 6.1 GILT NICHT FR DIE SOFTWAREPROGRAMME SELBST, DIE OHNE GEWHRLEISTUNG JEGLICHER ART ZUR VERFGUNG GESTELLT WERDEN. SOWEIT ES DAS ANWENDBARE RECHT ZULSST, LEHNEN EIDOS UND DESSEN LIZENZGEBER ALLE WEITEREN 

ZUSICHERUNGEN, GEWHRLEISTUNGEN, ZUSAGEN UND SONSTIGEN BESTIMMUNGEN HINSICHTLICH DES SOFTWAREPRODUKTES UND JEDWEDEM TEIL DAVON AB, UNABHNGIG DAVON, OB SIE AUSDRCKLICH ODER KONKLUDENT GEWHRT WORDEN SIND, EINSCHLIESSLICH, ABER NICHT BESCHRNKT AUF KONKLUDENTE GEWHRLEISTUNGEN UND/ODER ZUSAGEN HINSICHTLICH DER TAUGLICHKEIT, ZUFRIEDENSTELLENDEN QUALITT, NICHTVERLETZUNG DER RECHTE AN GEISTIGEM EIGENTUM UND EIGNUNG FR EINEN BESTIMMTEN ZWECK. UNBESCHADET 

DER ALLGEMEINGLTIGKEIT DIESER BESTIMMUNG, GEWHRLEISTET EIDOS WEDER, DASS DAS SOFTWAREPRODUKT FREI VON FEHLERN ODER OHNE UNTERBRECHUNG FUNKTIONSFHIG IST NOCH DASS FEHLER IN DEM SOFTWAREPRODUKT BEHOBEN WERDEN.



6.4 DARBER HINAUS UND SOWEIT ES DAS ANWENDBARE RECHT ZULSST:

(A) HAFTEN EIDOS ODER DESSEN LIZENZGEBER AUF KEINEN FALL FR IRGENDWELCHE SCHDEN GLEICH WELCHER ART (EINSCHLIESSLICH, OHNE BESCHRNKUNG AUF DIREKTE, INDIREKTE, ZUFLLIGE ODER FOLGESCHDEN AUS KRPERVERLETZUNG, ENTGANGENEM GEWINN, BETRIEBSUNTERBRECHUNG, VERLUST VON INFORMATIONEN ODER IRGENDEINEM ANDEREN VERMGENSSCHADEN) AUS

DER BENUTZUNG DIESES SOFTWAREPRODUKTS ODER AUS DER TATSACHE, DASS ES NICHT BENUTZT WERDEN KANN, SELBST WENN EIDOS AUF DIE MGLICHKEIT SOLCHER SCHDEN HINGEWIESEN WURDE.

(B) IST DIE MAXIMALE GESAMTHAFTUNG VON EIDOS UND DESSEN LIZENZGEBERN UNTER UND IN VERBINDUNG MIT DIESEM LIZENZVERTRAG ODER DER BENUTZUNG UND VERSUCHTEN BENUTZUNG DIESES SOFTWAREPRODUKTS AUF JEDEN FALL AUF DIE TATSCHLICH FR DAS SOFTWAREPRODUKT GEZAHLTE SUMME BEGRENZT.



6.5 Keine Bestimmung oder Bedingung dieses Lizenzvertrages schrnkt die Haftung von Eidos Ihnen gegenber ein oder schliet diese aus bei fahrlssigem Handeln mit Todesfolge oder Krperverletzung, soweit ein solcher Ausschluss oder eine solche Beschrnkung nach anwendbarem Gesetz ungesetzlich, nicht durchsetzbar oder nichtig ist. 



6.6 Einige Gerichtsbarkeiten lassen den Ausschluss oder Beschrnkungen der Gewhrleistung nach Absatz 6 nicht zu. Die Bestimmungen und Bedingungen des Absatz 6 haben keinen Einfluss auf Ihre Rechte aus geltenden Gesetzen, die je nach Staat/Gerichtsbarkeit variieren knnen.







7.  Geltendes Recht



7.1 Vorbehaltlich Absatz 7.2, unterliegt dieser Lizenzvertrag und jedwede Klage oder  Streitigkeit, gleich welcher Art, aus oder in Verbindung mit diesem Lizenzvertrag dem Recht von England und Wales und ist dahingehend auszulegen, es sei denn und insoweit Gesetze im Hinblick auf Geschfte mit Endverbrauchern in einer bestimmten Gerichtsbarkeit erfordern, dass dieser Lizenzvertrag den Gesetzen dieser Gerichtsbarkeit unterliegt und dahingehend auszulegen ist, um bindend und durchsetzbar zu sein; in einem solchen Fall gelten die lokalen Gesetze einer solcher Gerichtsbarkeit in dem geforderten Umfang.



7.2 Falls Sie dieses Softwareprodukt in den Vereinigten Staaten von Amerika erworben haben, unterliegt dieser Lizenzvertrag und jedwede Klage oder Streitigkeit, gleich welcher Art, aus oder in Verbindung mit diesem Lizenzvertrag dem Recht des Staates Kalifornien, USA, und ist dahingehend auszulegen.



7.3	Die UN-Konvention ber Handelskaufvertrge findet auf diesen Lizenzvertrag keine Anwendung.



8.	Verschiedenes



8.1	Falls Sie dieses Softwareprodukt in den Vereinigten Staaten von Amerika erworben haben, drfen Sie es nicht exportieren oder reimportieren, es sei denn, die Gesetze und Vorschriften der Vereinigten Staaten von Amerika berechtigen dazu oder lassen dies zu.  

8.2	Dieser Lizenzvertrag stellt den vollstndigen Vertrag zwischen Eidos und Ihnen hinsichtlich der Lizenzierung und Benutzung des Softwareprodukts dar und ersetzt smtliche frheren oder gleichzeitig bestehenden Vereinbarungen.  Jegliche Abnderung oder Abwandlung dieses Lizenzvertrages ist nur bindend, wenn diese schriftlich erfolgt ist und von einem bevollmchtigten Vertreter von Eidos unterzeichnet wurde.

Il presente Contratto di licenza con l'utente finale ("Contratto") costituisce il contratto tra l'utente ed Eidos Interactive Limited ("Eidos") relativamente al videogioco sopramenzionato, che include il software per il computer e tutti i supporti di memorizzazione associati, i materiali e altro tipo di documentazione, insieme a qualsiasi eventuale aggiornamento del videogioco fornito all'utente ("Prodotto software"). 

Il presente Prodotto software  protetto da copyright e altre leggi e trattati sulla propriet intellettuale. Il Prodotto Software viene concesso in licenza, non viene venduto.



EIDOS CONCEDE IN LICENZA L'UTILIZZO DEL PRODOTTO SOFTWARE UNICAMENTE SECONDO LE CONDIZIONI DEL PRESENTE CONTRATTO. LEGGERE LE DISPOSIZIONI DI LICENZA PRESENTATE DI SEGUITO. SE SI ACCETTANO TALI DISPOSIZIONI, FARE CLIC SU [I ACCEPT] ("ACCETTO") AL TERMINE DEL PRESENTE CONTRATTO PER AVVIARE L'INSTALLAZIONE DEL PRODOTTO SOFTWARE SUL COMPUTER DELL'UTENTE. SE NON SI ACCETTANO LE CONDIZIONI DEL PRESENTE CONTRATTO, FARE CLIC SU [NOT ACCEPTED] ("NON ACCETTATO") PER NON INSTALLARE IL PRODOTTO SOFTWARE SUL COMPUTER DELL'UTENTE. QUALORA L'UTENTE NON ACCETTI LE CONDIZIONI DEL PRESENTE CONTRATTO, DOVR, RESTITUIRE AL RIVENDITORE IL DISCO INUTILIZZATO INSIEME ALLA RELATIVA CONFEZIONE E DOCUMENTAZIONE PER OTTENERE IL RIMBORSO DEL PREZZO. IL FORNITORE SI RISERVA IL DIRITTO, SENZA PER QUESTO PREGIUDICARE I DIRITTI DELL'UTENTE STABILITI DALLA LEGGE, DI RIFIUTARE IN PARTE O IN TOTO IL RIMBORSO QUALORA IL DISCO, LA CONFEZIONE O LA DOCUMENTAZIONE SIANO STATI IN QUALSIASI MODO DANNEGGIATI.



1. Assistenza tecnica

Qualora sia necessaria assistenza tecnica, fare riferimento al manuale fornito in accompagnamento al prodotto Software o accederei al sito Web http://www.eidos.com oppure contattare la linea telefonica di assistenza tecnica per l'Europa al numero: 0870 90000222 OPPURE per il Nord America al numero 415-615-6220.

Le spese telefoniche sono a carico dell'utente.



2. Licenza

All'utente  consentito:

(a) caricare e utilizzare il Prodotto software su un singolo computer che soddisfi le specifiche tecniche indicate nel manuale, sotto il controllo e la custodia dell'utente e per proprio uso privato e domestico;

(b) trasferire il Prodotto software da un computer a un altro a condizione che sia utilizzato unicamente su un solo computer alla volta e che qualsiasi computer sul quale il Prodotto software venga utilizzato sia sotto il controllo e la custodia dell'utente al momento dell'utilizzo;

(c) trasferire il Prodotto software completo di tutta la documentazione e i vantaggi del presente Contratto a un'altra persona a condizione che tale persona accetti le condizioni del presente Contratto e l'utente trasferisca tutte le eventuali ulteriori copie consentite del Prodotto software al nuovo utente oppure distrugga tutte le copie non trasferite. Qualora il destinatario del trasferimento non accetti tali condizioni, il presente Contratto terminer automaticamente. 

Eidos e i suoi licenzianti si riservano tutti i diritti non espressamente concessi dal presente Contratto nei limiti consentiti dalla legge in vigore. I diritti dell'utente garantiti dal presente Contratto sono rigorosamente soggetti al rispetto dei relativi termini e condizioni.



3. Limitazioni

All'utente non  consentito:

(a) caricare il Prodotto software su un server di rete a scopi di distribuzione su 

uno o pi computer sulla rete oppure allo scopo di effettuarne la distribuzione;

(b) fatta eccezione per quanto espressamente consentito dal presente Contratto e nei limiti delle circostanze espressamente consentite dalla legge applicabile, affittare, concedere in leasing, concedere in licenza, prestare, sfruttare a scopo di lucro, copiare, modificare, adattare, incorporare, tradurre, decodificare, decompilare, disassemblare o creare lavori derivati basati in toto o in parte sul Prodotto software, o altrimenti utilizzare, riprodurre o scambiare il Prodotto software o parte di esso in alcun modo.



4.  Risoluzione del Contratto

Senza per questo pregiudicare altri diritti, Eidos potr terminare il presente Contratto immediatamente e senza preavviso qualora l'utente non si attenga ai termini e alle condizioni del presente Contratto. Nell'evento della cessazione del Contratto, l'utente dovr distruggere tutte le copie del prodotto Software e relative parti componenti, incluse tutte le copie del Prodotto software memorizzato nel disco rigido di qualsiasi computer. Tutte le disposizioni del presente Contratto relativamente a esclusioni di garanzia, limitazioni di responsabilit, tutele, danni e diritti di propriet di Eidos avranno effetto anche dopo la risoluzione del presente Contratto.





5.  Propriet

L'utente  proprietario unicamente del supporto sul quale  registrato il prodotto Software. Eidos e/o i suoi licenzianti riterranno in ogni momento la propriet del Prodotto software registrato sul supporto e di tutte le eventuali successive copie, indipendentemente dal formato.



6.  Garanzia limitata ed esclusioni



6.1  GARANZIA LIMITATA



La presente garanzia limitata non sostituisce i diritti dell'utente stabiliti dalla legge.

Eidos garantisce all'acquirente originale del presente Prodotto software che il supporto di registrazione utilizzato per quest'ultimo sar privo di difetti di materiale e di fabbricazione, in condizioni di uso e servizio normali, per un periodo di novanta (90) giorni dalla data di acquisto. La responsabilit di Eidos in base alla presente garanzia limitata sar, a propria esclusiva discrezione, (a) la restituzione del prezzo di acquisto; oppure (b) la riparazione o, a discrezione di Eidos, la sostituzione gratuita del Prodotto software difettoso secondo i termini della presente garanzia limitata, a condizione che il prodotto originale venga restituito a Eidos o al rivenditore nelle condizioni originali all'indirizzo specificato nel manuale che accompagna il Prodotto Software, insieme a una regolare fattura indicante la data di acquisto, una descrizione del difetto e un indirizzo di spedizione. Eidos si incaricher dei costi di spedizione all'utente del Prodotto software sostitutivo. 





6.2  La garanzia limitata al paragrafo 6.1 sar nulla e non applicabile a supporti sottoposti a uso improprio, incidenti, danni o eccessiva usura. Qualunque Prodotto software sostitutivo verr garantito per il periodo pi lungo tra il rimanente periodo della garanzia originale o trenta (30) giorni.





6.3 LA GARANZIA LIMITATA AL PARAGRAFO 6.1 NON SI APPLICA AI PROGRAMMI SOFTWARE, I QUALI VENGONO FORNITI "COS COME SONO" E SENZA ALCUNA GARANZIA O DICHIARAZIONE DI ALCUN TIPO. NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE IN VIGORE, EIDOS E I SUOI LICENZIANTI NON RICONOSCONO ALCUNA ALTRA GARANZIA O CONDIZIONE, IMPLICITA O ESPLICITA, COMPRESE, TRA LE ALTRE, GARANZIE E/O CONDIZIONI DI COMMERCIABILIT, QUALIT SODDISFACENTE, NON VIOLAZIONE DI DIRITTI DI PROPRIET INTELLETTUALE E IDONEIT PER UN FINE PARTICOLARE, RELATIVAMENTE AL PRODOTTO SOFTWARE E A CIASCUNA SUA PARTE.

SENZA PREGIUDICARE LE SUDDETTE, EIDOS NON RILASCIA ALCUNA GARANZIA CHE IL PRODOTTO SOFTWARE SIA PRIVO DI ERRORI O CHE FUNZIONER SENZA INTERRUZIONI, N CHE SAR IN GRADO DI RISOLVERE ERRORI INTERNI AL PRODOTTO SOFTWARE STESSO.



6.4 OLTRE A CI, NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE IN VIGORE:

 

(A) IN NESSUN CASO EIDOS O I SUOI LICENZIANTI SARANNO RESPONSABILI PER DANNI (INCLUSI, SENZA LIMITAZIONI, DANNI DIRETTI, INDIRETTI, ACCIDENTALI, DANNI FISICI ALLA PERSONA, DANNI PER PERDITA O MANCATO GUADAGNO, INTERRUZIONE DELL'ATTIVIT, PERDITA DI INFORMAZIONI O ALTRE PERDITE ECONOMICHE) DERIVANTI DALL'USO O DALL'INCAPACIT DI FARE USO DEL PRODOTTO SOFTWARE, ANCHE NEL CASO IN CUI EIDOS SIA STATA AVVERTITA DELLA POSSIBILIT DI TALI DANNI.

(B) LA RESPONSABILIT COMPLESSIVA DI EIDOS E DEI SUOI LICENZIANTI RISULTANTE DA O RELATIVAMENTE ALLE DISPOSIZIONI DEL PRESENTE CONTRATTO O DAL TENTATO UTILIZZO DEL PRESENTE PRODOTTO SOFTWARE NON POTR ECCEDERE L'IMPORTO PAGATO DALL'UTENTE PER IL PRODOTTO SOFTWARE.



6.5 Nessun elemento del presente Contratto limita o esclude la responsabilit di Eidos nei confronti dell'utente per negligenza che comporti morte o ferite alla persona, nella misura in cui tale esclusione o limitazione sia illecita, non applicabile o nulla secondo le leggi in vigore. 



6.6 Alcune giurisdizioni potrebbero non riconoscere le dichiarazioni di non responsabilit o i limiti di responsabilit secondo quanto enunciato nella presente sezione 6. Nessun elemento enunciato nella sezione 6 influenzer i diritti dell'utente stabiliti dalla legge, differenti in ogni stato o giurisdizione.







7.  Legge applicabile



7.1 In base alle disposizioni del paragrafo 7.2 sotto riportato, il presente Contratto e qualsiasi richiesta o controversia di qualsivoglia natura derivante da o correlata al presente Contratto sar disciplinata da e interpretata in conformit alle leggi di Inghilterra e Galles, salvo che e nella misura in cui le leggi relative a transazioni con clienti in specifiche giurisdizioni comportino che, per essere ritenuto vincolante e applicabile, il presente Contratto sia siciplinato da e interpretato in conformit alle leggi di tale giurisdizione, nel qual caso le normative del singolo paese per tale giurisdizione saranno applicabili nella misura richiesta.



7.2 Qualora il Prodotto software sia stato acquistato negli Stai Uniti, il presente Contratto e qualsiasi richiesta o controversia di qualsivoglia natura derivante da o relativa al presente Contratto sar disciplinata da e interpretata in conformit con le leggi dello stato della California, Stati Uniti d'America.



7.3	La convenzione dell'Organizzazione delle Nazioni Unite sui contratti per la vendita internazionale di beni (Contracts for the International Sale of Goods) non  applicabile al presente Contratto.



8.	Varie



8.1	Qualora il Prodotto software sia stato acquistato negli Stai Uniti, l'utente si impegna a non esportarlo o ri-esportarlo fatta eccezione per i casi in cui sia consentito dalle leggi e dalle normative degli Stati Uniti d'America.  

8.2	Il presente Contratto costituisce il contratto complessivo tra Eidos e l'utente relativamente alla licenza e all'utilizzo del Prodotto software e sostituisce qualsiasi altra comunicazione precedente o contemporanea.  Nessuna modifica al presente Contratto sar vincolante salvo in forma di accordo scritto debitamente sottoscritto da un rappresentante autorizzato di Eidos.

Este Acuerdo de licencia del usuario final ("EULA") es un contrato legal entre el usuario y Eidos Interactive Limited ("Eidos" o "nosotros") referente al programa de juego de ordenador arriba mencionado y que incluye el software informtico y los soportes asociados, los materiales y la documentacin adicional junto con cualquier actualizacin del programa de juego original que se le suministre ("Producto de software"). 

Este Producto de software est protegido por las leyes y tratados de copyright y de proteccin de la propiedad intelectual. Este Producto de software no se vende; su uso se lleva a cabo bajo licencia.



LA CONCESIN AL USUARIO DE LA LICENCIA DE USO DE ESTE PRODUCTO DE SOFTWARE SE REALIZA NICAMENTE BAJO LAS CONDICIONES DE ESTE ACUERDO DE LICENCIA (EULA). HAGA EL FAVOR DE LEER DETENIDAMENTE LAS CONDICIONES DE LICENCIA SIGUIENTES. SI ACEPTA SOMETERSE A ELLAS, PULSE EL BOTN DE ACEPTACIN UBICADO AL FINAL DE ESTE ACUERDO. EN ESE INSTANTE, EL PRODUCTO DE SOFTWARE SE INSTALAR EN EL EQUIPO. SI NO ACEPTA SOMETERSE A LAS CONDICIONES DE ESTE ACUERDO DE LICENCIA, PULSE EL BOTN DE NO ACEPTACIN Y EL PRODUCTO DE SOFTWARE NO SE INSTALAR EN EL EQUIPO. SI NO ACEPTA LAS CONDICIONES DE ESTE ACUERDO DE LICENCIA, LE ROGAMOS QUE DEVUELVA EL DISCO SIN USAR JUNTO CON EL PAQUETE Y LA DOCUMENTACIN, EN EL PUNTO DE VENTA A FIN DE SOLICITAR EL REEMBOLSO DEL PRECIO DE ADQUISICIN DE ESTE PRODUCTO DE SOFTWARE. EL PROVEEDOR SE RESERVA EL DERECHO DE RETENER PARTE O EL TOTAL DEL IMPORTE DE DEVOLUCIN EN EL CASO DE QUE EL DISCO, EL PAQUETE O LA DOCUMENTACIN HAYAN SUFRIDO CUALQUIER DAO, SIN QUE ESTO AFECTE A LOS DERECHOS LEGALES DEL USUARIO.

El usuario ser responsable de todos los gastos telefnicos.



2. Licencia

Tiene permiso para hacer lo siguiente:

(a) instalar el Producto de software y utilizarlo en un equipo individual que est bajo su custodia y control, y que cumpla las especificaciones indicadas en el manual para el uso propio privado y domstico;

(b) transferir el Producto de software de un equipo a otro siempre que solamente se utilice en uno de ellos al mismo tiempo y que cualquier equipo en el que se utilice est bajo su custodia y control durante el tiempo de utilizacin;

(c) transferir el Producto de software (completo junto con la documentacin) y las ventajas de este Acuerdo de licencia a otra persona siempre que dicha persona acepte las condiciones de dicho Acuerdo de licencia y que el usuario transfiera de forma inmediata cualquier copia  permitida del Producto de software de la que disponga a dicha persona o bien destruya todas las copias no transferidas. Si el cesionario no acepta estas condiciones, el Acuerdo de licencia se considerar automticamente terminado. 

Todos los derechos que no hayan sido concedidos expresamente por el presente documento estarn, hasta los lmites fijados por la ley, reservados a Eidos y a sus otorgantes de licencias. El derecho de uso segn este Acuerdo de licencia est condicionado de modo estricto por el cumplimiento de los trminos y condiciones de este Acuerdo.



3. Restricciones

No tiene permiso para lo siguiente:

(a) instalar el Producto de software en un servidor de red con el objeto de distribuirlo en  

uno o ms equipos de dicha red o de efectuar dicha distribucin.

(b) excepto en los casos permitidos expresamente por este Acuerdo de licencia y hasta el lmite y en las circunstancias permitidas expresamente por la legislacin vigente, alquilar, arrendar, subarrendar, prestar, explotar con fines comerciales o de otra ndole, copiar, modificar, adaptar, fusionar, traducir, realizar ingeniera inversa, descompilar, desmontar o crear trabajos derivados basados de forma total o parcial en el Producto de software o bien utilizar, reproducir o comerciar de cualquier manera con el Producto de software o cualquier parte del mismo.



4.  Terminacin

Sin menoscabo de otros derechos, Eidos puede terminar este Acuerdo de licencia del usuario final de forma inmediata y sin previo aviso si el usuario incumple los trminos y condiciones del mismo. En caso de terminacin, el usuario debe destruir todas las copias del Producto de software y dems componentes, incluyendo todo Producto de software almacenado en el disco duro de cualquier equipo. Todas las provisiones de este Acuerdo de licencia del usuario final relativas a renuncias de garantas, limitaciones de responsabilidad, recursos o daos y a los derechos de propiedad de Eidos permanecern vigentes despus de la terminacin.





5.  Propiedad

El usuario slo es propietario del soporte en el que est grabado el Producto de software. Eidos y sus otorgantes de licencia conservarn en todo momento la propiedad del Producto de software tal y como est grabado en el soporte y de todas las copias subsiguientes del mismo, independientemente de su forma.



6.  Garanta limitada y exclusiones



6.1  GARANTA LIMITADA



Esta garanta limitada forma parte de los derechos legales del usuario y no afecta a los mismos.

Eidos garantiza al comprador original de este Producto de software que el soporte fsico en el que est grabado estar, en condiciones de uso normales, libre de defectos materiales en lo referente al soporte fsico y a la fabricacin por un plazo de noventa (90) das a partir de la fecha de adquisicin. Segn esta garanta limitada, la responsabilidad total de Eidos consistir, bajo la entera discrecin de esta empresa, en (a) reembolsar el 

precio de compra pagado; o bien (b) reparar o, a discrecin de Eidos, sustituir de manera gratuita el Producto de software que no cumpla con esta garanta limitada, siempre que el usuario devuelva el soporte fsico original en su condicin original al punto de venta o a Eidos en la direccin indicada en el manual que acompaa al Producto de software, junto con una prueba de compra fechada, una declaracin descriptiva de los defectos y una direccin postal de devolucin. Eidos pagar los gastos de envo del Producto de software sustitutorio al usuario. 



6.2  La garanta limitada del prrafo 6.1 anterior ser nula y no aplicable en caso de que el soporte haya sufrido un uso inadecuado, accidente, dao o desgaste excesivo. Todo Producto de software sustitutorio estar garantizado por el tiempo que reste del 

plazo de la garanta original o por treinta (30) das, el que sea ms largo de ambos perodos.





6.3 LA GARANTA LIMITADA DEL PRRAFO 6.1 NO SE APLICA A LOS PROGRAMAS DE SOFTWARE PROPIAMENTE DICHOS, QUE SE SUMINISTRAN "TAL CUAL", SIN GARANTA DE NINGUNA CLASE. HASTA EL LMITE MXIMO PERMITIDO POR LA LEGISLACIN VIGENTE, EIDOS Y SUS OTORGANTES DE LICENCIAS RENUNCIAN A CUALQUIER OTRA 

REPRESENTACIN, GARANTA, CONDICIN U OTROS TRMINOS, YA SEAN EXPRESOS O IMPLCITOS, INCLUYENDO, PERO SIN LIMITARSE A ELLAS, LAS GARANTAS  IMPLCITAS Y/O LAS CONDICIONES DE COMERCIABILIDAD, CALIDAD SATISFACTORIA, RESPETO A LOS DERECHOS DE PROPIEDAD INTELECTUAL E IDIONEIDAD PARA UN PROPSITO CONCRETO, REFERENTES AL PRODUCTO DE SOFTWARE Y A CUALQUIER PARTE DEL MISMO. SIN 

MENOSCABO DE LO ANTERIORMENTE ESTABLECIDO, EIDOS NO GARANTIZA QUE EL PRODUCTO DE SOFTWARE ESTAR LIBRE DE ERRORES O QUE FUNCIONAR SIN INTERRUPCIN, NI QUE REPARAR CUALQUIER ERROR DEL PRODUCTO DE SOFTWARE.



6.4 ASIMISMO, Y HASTA EL LMITE MXIMO PERMITIDO POR LA LEGISLACIN VIGENTE:

(A) EIDOS O SUS OTORGANTES DE LICENCIAS NO SERN EN NINGN CASO RESPONSABLES DE CUALQUIER DAO (INCLUYENDO, PERO SIN LIMITARSE A ELLOS, LOS DAOS DIRECTOS, INDIRECTOS, CONTINGENTES O CONSECUENTES POR LESIONES PERSONALES, PRDIDA DE BENEFICIOS, INTERRUPCIN DE LA ACTIVIDAD COMERCIAL, PRDIDA DE INFORMACIN O CUALQUIER PRDIDA PECUNIARIA) DERIVADO DEL 

USO O LA INCAPACIDAD PARA UTILIZAR ESTE PRODUCTO DE SOFTWARE, INCLUSO EN EL CASO DE QUE EIDOS HAYA SIDO ADVERTIDO DE LA POSIBILIDAD DE TALES DAOS.

(B) EN CUALQUIER CASO, LA MXIMA RESPONSABILIDAD ACUMULADA DE EIDOS Y SUS OTORGANTES DE LICENCIAS SEGN O EN RELACIN CON ESTE ACUERDO DE LICENCIA O CON EL USO O EL USO TENTATIVO DE ESTE PRODUCTO DE SOFTWARE QUEDAR LIMITADA A LA CANTIDAD PAGADA POR EL USUARIO AL COMPRAR EL PRODUCTO DE SOFTWARE.



6.5 Ninguna de las condiciones de este Acuerdo de licencia limitar o eximir a Eidos de responsabilidad frente al usuario por lesiones personales o muerte, hasta el extremo que dicha exclusin o limitacin pueda considerarse ilegal, imposible de aplicar o nula conforme a cualquier legislacin vigente. 



6.6 Algunas jurisdicciones no permiten las renuncias de garantas o las limitaciones de responsabilidad establecidas en el prrafo 6. Nada de lo dispuesto en dicho prrafo 6 afectar a los derechos legales del usuario, que pueden variar de un estado o jurisdiccin a otro.







7.  Legislacin aplicable



7.1 Segn lo establecido en el prrafo 7.2 ms abajo, este Acuerdo de licencia y cualquier reclamacin o disputa de cualquier naturaleza derivada del mismo se regirn  y se interpretarn de acuerdo con las leyes de Inglaterra y Pas de Gales, a no ser que, y limitndose a ellas, las leyes relativas a las transacciones con los consumidores en una jurisdiccin especfica exijan que este Acuerdo de licencia se rija e interprete de conformidad con las legislaciones de dichas jurisdicciones con el objeto de que sea vinculante y garantizar su cumplimiento, en cuyo caso, se aplicarn las leyes locales de dicha jurisdiccin, hasta el extremo en que sea necesario.



7.2 Si ha adquirido este Producto de software en EE.UU., este Acuerdo de licencia y cualquier reclamacin o disputa de cualquier naturaleza derivada o relacionada con el mismo estar regida y ser interpretada de conformidad con la legislacin del estado de California, EE.UU.



7.3	La Convencin de Naciones Unidas sobre contratos para la venta internacional de bienes no ser aplicable a este Acuerdo de licencia.



8.	Otras disposiciones



8.1	Si ha adquirido este Producto de software en EE.UU., no podr exportarlo o re-exportarlo excepto en la medida en que est permitido y autorizado por las leyes y reglamentos de los Estados Unidos de Amrica.  

8.2	Este Acuerdo de licencia constituye la totalidad del acuerdo entre Eidos y el usuario con respecto a la licencia y el uso del Producto de software y anula cualquier otro acuerdo anterior o simultneo.  Ninguna correccin o modificacin de este Acuerdo de licencia ser vinculante a no ser que se realice por escrito y est firmada por un representante debidamente autorizado de Eidos.
